Mortgage Relief Passed by Congress & Signed Into Law by the President!

On Thursday, December 20th, President Bush signed into law a bill passed by Congress: HR 3648 -Mortgage Forgiveness Debt Relief Act of 2007.  The three major points are:

mortgage comicElimination of the “phantom tax” on foreclosures, short sales or other discharges of debt on a primary residence.  Consider this scenario:  A property is worth $250,000, and the mortgage balance is $300,000.  Under the old rules, if a lender forgave the $50k difference as part of a foreclosure, short sale, refinance or loan modification, the borrower had to claim the $50k as income and pay federal income taxes on that amount.  The new law eliminates this “phantom tax”, and the forgiven debt is no longer treated as taxable income to the borrower as long as certain requirements are met, such as the discharged mortgage balance must be on the taxpayer’s principal residence.

The tax deduction for mortgage insurance premiums is now extended until December 31, 2010 instead of expiring at the end of 2007. The same rules apply as before in terms of the income limitations etc., and these rules are covered in the taxation section of the CMPS curriculum.

The capital gains exclusion is now $500,000 instead of $250,000 for an unmarried individual who sells their primary residence within 2 years of the time their spouse has died.  This new guideline applies to sales after December 31, 2007, and provides relief for widows and widowers by giving them a 2 year window from the time their spouse
has died to sell their home and receive the $500,000 exclusion.  Of course, the same rules apply as before, where the individual(s) need to have lived in the home as their primary residence for 2 out of the last 5 years.

Circle G Ranches is a charming neighborhood of about 25 luxury homes built 20 years ago. These elegant homes all participate in decorating for the holidays. Some homes even have their lights set to music on a radio station you can tune into from your car.

McCormick-Stillman Railroad Park in Scottsdale: More than 100,000 lights will adorn trees and displays during McCormick-Stillman Railroad Park’s Holiday Lights event. Festivities kick off at 6:30 p.m. Friday, Dec. 14 with a tree lighting, entertainment and a visit from a special guest — Santa! Holiday lights runs from 6:30 to 9 p.m., through Saturday, Jan. 5, excluding Dec. 24, 25 and 31. Santa will be there nightly through Dec. 23. F.Q. Story District Historic Home Tour

The F.Q. Story Historic District held it’s 23rd Annual Home Tour & Gift Sale on December 1st and 2nd.  Saturday evening featured Dickens Carolers and glowing luminaries.  Since the weather was damp (read: raining ALL day & night), I attended the Home Tour during Sunday afternoon.  However, I heard that the neighborhood has 300-400 people visit Saturday evening!  I still think that the area is best viewed in daylight.  In addition to 10 homes inviting tour go-ers to see inside their piece of Phoenix history, the 1920’s neighborhood hosted a large holiday bazaar in the streets with crafts, food and sweets.  Tickets to see the 10 homes were $15 dollars.  Some homes for sale in the area held open houses.  The entire Portland Street was blocked off and the 10 homes made for a very very nice walk.  There was also a free trolley available but it was so nice out, I walked.  Enjoy the pictures, leave a comment and mark your calendars for next year’s F.Q. Noelle, a Holiday Movie

Noelle is almost here! December 7th, 2007 a new movie hits only a handful of theatres.  I haven’t seen the movie yet, but the trailer for Noelle looks intriguing.  Thanks to my bookclub friend Missy for sharing the news about this holiday movie.  Noelle is a film about guilt, shame, hope and faith – emotions we all have plenty of especially around the holidays. Noelle will be shown at the Arizona Mills Mall theatres in Tempe, the Mesa Grand 24 at Stapley/Hwy 60, the Superstition Spring Mall in Mesa, and about 5 other theatres in the Phoenix Metro area.  Check out www.noellethemovie.com for more info.
